1. Acceptance of Terms

By accessing or using AutoACP5, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Description of Service

AutoACP5 is a web-based tool that automates the filing of NYC DEP ACP5 forms. The service uses browser automation to interact with the NYC DEP portal on behalf of the user.

3. Account Registration

Users must provide accurate information when creating an account. Users are responsible for maintaining the security of their account credentials, including DEP portal credentials.

4. DEP Portal Credentials

Users provide their NYC DEP portal username and password to enable automation. These credentials are stored securely and used solely for the purpose of filing ACP5 forms on the user's behalf. AutoACP5 does not share credentials with third parties.

5. Billing and Payment

Subscription fees are billed monthly. Pay-per-job fees are charged at the time of automation. Filing fees ($47.94) are separate from AutoACP5 service fees. Refunds are handled on a case-by-case basis.

6. Accuracy of Filings

While AutoACP5 automates the data entry process, users are responsible for the accuracy of all information provided. The certified asbestos investigator remains legally responsible for the content of all ACP5 filings.

7. Service Availability

AutoACP5 depends on the availability of the NYC DEP portal. Service may be temporarily unavailable during DEP portal maintenance, server updates, or unforeseen technical issues.

8. Limitation of Liability

AutoACP5 is provided "as is." Kiso Systems LLC is not liable for errors in filings resulting from incorrect user input, DEP portal changes, or service interruptions.

9. Intellectual Property

All content, features, and functionality of AutoACP5 are owned by Kiso Systems LLC.

10. Termination

We may suspend or terminate accounts that violate these terms. Users may cancel their subscription at any time through the billing portal.

12. Changes to Terms

We may update these terms from time to time. Continued use of the service constitutes acceptance of updated terms.
